Terms of Use

1. What FriendsWithBets is — and is not

FriendsWithBets is a points-only game for private groups of friends. Members of a private group (a "league") make weekly picks on NFL and college football games against a point spread, and the Service keeps score in points.

• FriendsWithBets is not a sportsbook, casino, lottery, sweepstakes, or gambling operator, and it does not offer gambling services.
• The Service does not accept, hold, transmit, or pay out money or anything of value. We do not run a prize, payout, or reward program.
• Points are a scorekeeping device only. They have no cash value, cannot be bought, sold, redeemed, or transferred outside a league, and are never owed to or by FriendsWithBets.
• Every point that moves between balances moves between members of the same league. The "House" in a given week is always a league member, never FriendsWithBets or any company.
• No purchase or payment is required to use the Service.

2. Eligibility

You must be at least 21 years old and able to form a binding contract to create an account or use the Service. By signing up you confirm that you meet this requirement. We may suspend or delete any account if we believe the member is under that age or has given false information. The Service is not directed to anyone under 21.

The Service is intended for use in the United States. You are responsible for knowing and following the laws that apply to you where you live. Do not use the Service if doing so is prohibited where you are.

3. Arrangements among members

Standings, balances, and any "settle up" or final-balance figures shown in the Service are informational point totals. They are not a bill, invoice, debt, or claim for money or property, and FriendsWithBets cannot and does not enforce them.

What members choose to do outside the Service is a private matter among them. FriendsWithBets does not facilitate, arrange, collect, hold, guarantee, or take part in any such arrangement, and is not responsible for it.

You agree not to use the Service to run, advertise, or facilitate betting or wagering for money or anything of value; to collect or pay stakes, winnings, or fees; or to operate a league open to the general public. League Managers are responsible for keeping their league private and for the conduct of their league.

4. Accounts and security

• Provide accurate information and keep it current. One person, one account.
• Keep your password and any two-factor authentication device secure. You are responsible for activity under your account. Tell us promptly if you believe it has been compromised.
• We may require two-factor authentication or other security steps.

5. Leagues

• Anyone with an account may request a new league. New leagues require our approval, and we may approve, reject, suspend, or remove any league at our discretion.
• A league is limited to 6 active members. Joining requires the league's invite code. Do not publish invite codes publicly.
• The League Manager sets the league's pick settings and may edit spreads, rosters, and House rotation as the Service allows. Other members rely on the League Manager to administer the league fairly.
• A League Manager may drop a member from a league. A dropped member stays in that league's Standings, Settle up, and history, leaves the House rotation, stops accruing missed-pick losses, and can no longer place picks. The Service records the drop, and League Managers can see a flag on a member who has dropped out of a league.
• A League Manager may write a "league constitution" for the league. It is written by the League Manager, not by us; it must not describe money, prizes, or payouts, and we do not enforce it.

6. Acceptable use

You agree not to: break the law; harass, threaten, or discriminate against others (including on the Message board); post spam, malware, or content you do not have the right to post; attempt to access other leagues' data or accounts; probe, scrape, overload, or circumvent the Service's security or limits; manipulate scores, spreads, or standings other than through features the Service provides; or use the Service to deceive anyone. We may remove content and suspend or terminate accounts that violate these Terms.

You keep ownership of what you post. You give us a limited license to store and display your content to the members of your league as needed to run the Service.

7. Spreads, scores, and accuracy

Point spreads and game results come from third-party data sources and may be late, unavailable, or wrong, and League Managers may override them. A pick is locked at the spread shown when you submit it. We do not guarantee the accuracy, timeliness, or availability of any data. We may correct scores, spreads, and ledger entries, and for purposes of the Service our corrected figures control.

8. Sports leagues, schools, and team names

FriendsWithBets is not affiliated with, sponsored by, or endorsed by the National Football League, the NCAA, any collegiate athletic conference, or any professional or college team or school. League, conference, school, and team names are used only to identify games.

9. Responsible play

This is a game for fun among friends. If gambling is or may be a problem for you or someone you know, call or text 1-800-GAMBLER (U.S.) for confidential help.

10. Privacy

Our Privacy Policy explains what we collect and how we use it. It is part of these Terms.

11. Our rights

The Service, its software, design, and branding belong to us or our licensors. We give you a limited, revocable, non-transferable license to use the Service for its intended purpose. Do not copy, modify, or reverse engineer it except as the law allows.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FRIENDSWITHBETS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY ARRANGEMENT BETWEEN MEMBERS, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

14. Indemnity

You agree to indemnify and hold us harmless from claims arising from your violation of these Terms, your content, or any arrangement you make with other members.

15. Suspension, termination, and deletion

You may stop using the Service at any time and may ask us to delete your account by emailing fnfscott4@gmail.com. We may suspend or end your access at any time, including for violations of these Terms. Sections that by nature should survive termination will survive.

16. Changes

We may update these Terms. If a change is material we will tell you through the Service or by email, and may ask you to accept the new version. Continued use after the effective date means you accept the update.

17. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. If you have a dispute with us, please email fnfscott4@gmail.com first so we can try to resolve it informally. Any claim that cannot be resolved informally must be brought in the state or federal courts located in North Carolina.
